Liberty Lesson – Birthright Citizenship – Springboro, OH 08/22/26

Once again, the Supreme Court has handed down an opinion on birthright citizenship that deserves a closer look. The Court says the Fourteenth Amendment guarantees citizenship to nearly anyone born on American soil. But that conclusion rests on a reading of the Citizenship Clause that is far less settled than the majority suggests.

That interpretation should not be accepted as obvious simply because the Court has declared it so.
Read the text of the Fourteenth Amendment. Read Vattel’s Law of Nations. Read the congressional debates surrounding the amendment—especially the discussion of the phrase “subject to the jurisdiction thereof.” Taken together, those sources raise a serious question: did the amendment truly grant automatic U.S. citizenship to every person born within the nation’s borders, regardless of the parents’ allegiance, legal status, or relationship to the United States? That is the question the Court too quickly brushed aside.
